Terms and Conditions

These Terms and Conditions apply to your membership and participation with Motor Culture Australia. They set out the terms for our VIP Members Club, the specific terms for each of our current promotions (including our draws and Scratch & Win), and our photography, videography and media terms, including the media release that applies when you attend our events. Please read the sections relevant to you, and use the links below to jump to any section.

Terms and Conditions – VIP Members Club

Motor Culture Australia Pty Ltd (hereinafter referred to as ‘Motor Culture Australia’ or ‘We’ or ‘Us’ or ‘Our’) is conducting lucky draws (hereinafter referred to as the ‘Contest’) for Individuals (hereinafter referred to as ‘Participant’ or ‘Participants’ or ‘Members’ or ‘Entrants’ or ‘Them’ or ‘You’ or ‘Your’). The Contest will commence at various times and all contests will be held at Motor Culture Australia, 87 Dunhill Crescent, QLD 4170. The winner will be drawn and contacted immediately via phone and email.

Conditions of participant entry into the contest

For a participant to be eligible to enter the contest. They must purchase one of our official VIP Memberships which will automatically enter them into the contest. Access to our VIP Memberships will be provided by us on all our advertisements, social media platforms and via contacting us directly. Please see our website for details on our VIP Memberships at motorcultureaustralia.com/benefits

The contest is open to all Australian residents (excluding South Australian residents) over the age of 18 who enter in accordance with the terms and conditions of entry.

The participants are required to purchase one of our VIP Memberships via motorcultureaustralia.com or via the links we provide on our social media platforms, which will automatically place them in the contest.

Participants can purchase a VIP Membership over the phone via the number supplied in our advertisements and on our website. The participant will not pay a call charge fee. Motor Culture Australia covers all call fees.

By signing up as a VIP Member, which is a subscription-based platform. Participants are granted the following number of entries in every Trade promotional draw.

Mini VIP Membership – Receive 4 Entries in every draw
Standard VIP Membership – Receive 10 Entries in every draw
Premium VIP Membership – Receive 25 Entries in every draw

VIP Members entries are accumulative every month.

The contests are going to be held at Motor Culture Australia, on various different dates, please refer to each individual T&C’s. We welcome all participants and the public to attend.

The winners of the contest will be drawn and announced live via our social media platforms. The Winners will be published to our Facebook, Instagram and Website. You can view the winners via this link: https://www.motorcultureaustralia.com/

The contest will be scrutinised by an official scrutineer and the winner will be contacted immediately via phone if they are not present at the event.

We will deliver the prizes to the winners Australia-wide, within 21 business days of the event.

We will cover all delivery costs. As well as assist with the on-road process, however due to the nature of the vehicles, the winner is solely responsible for paying any duties, taxes, registration fees, fuel, parts, servicing and operating costs associated with the vehicle.

If the prize is unclaimed for longer than the period of 90 days from the initial draw, we will conduct a redraw and a new winner will be announced at Motor Culture Australia. For VIP Only Draws, the contest is not limited to a set number of entrants. It is however limited to VIP Members only.

VIP Members can cancel their subscription at any time, switch between tiers of membership at any time or contact us at any time for special requests.

Every entrant has an equal and fair chance of winning each prize. Meaning, one entrant can win multiple prizes in the competition.

The VIP Members are not eligible to automatically enter any in-person event promotional draws. Please refer to the individual Terms and Conditions set out for the in-person event promotions to understand the eligibility criteria. Any event related promotions may require the event attendees to be physically at the event to be eligible for any promotions.

VIP Membership Subscription Terms

Motor Culture Australia offers Monthly VIP Memberships and Annual VIP Memberships (“VIP Memberships”). By purchasing or maintaining a VIP Membership, the Member agrees to the following subscription terms.

Annual VIP Memberships require the full annual fee to be paid upfront. Despite upfront payment, promotional entries included with an Annual Membership are allocated monthly over the twelve-month term and are not issued upfront. Monthly VIP Memberships receive promotional entries monthly in accordance with their applicable tier.

All VIP Membership payments, whether Monthly or Annual, are strictly non-refundable to the maximum extent permitted by law. This includes, without limitation, early cancellation, change of mind, failure to utilise Membership benefits, or any unused portion of an Annual Membership. No refund, credit or compensation shall be provided once a Membership payment has been processed.

A Member may cancel their VIP Membership at any time. Cancellation takes effect immediately. Upon cancellation, whether Monthly or Annual, the Member forfeits all accumulated promotional entries and is removed from all future promotional draws. Cancellation of an Annual Membership prior to the expiry of the twelve-month term does not entitle the Member to any refund or credit for the remaining period.

Where a Member upgrades from a Monthly VIP Membership to an Annual VIP Membership, the Annual term commences immediately upon successful payment. The Monthly Membership is deemed terminated at that time. Promotional entry allocations will continue under the Annual Membership schedule, and any entries accumulated before the upgrade remain valid unless the Annual Membership is later cancelled.

A VIP Membership remains active only while payments are successfully processed. If a payment fails, the Membership will automatically be marked as inactive. The system will attempt to re-process the failed payment over the following days; however, during any period of failed payment or inactive status, no promotional entries will be allocated. If the payment is not successfully recovered and the Membership is not reactivated, all accumulated entries may be forfeited at the sole discretion of Motor Culture Australia.

Promotional entries have no monetary value. They cannot be redeemed, exchanged, transferred, converted to cash, or assigned to another person. Entries exist solely as promotional rewards linked to active VIP Memberships.

Motor Culture Australia reserves the right to amend, vary, or update Membership tiers, pricing, benefits or entry allocations at any time. Changes apply prospectively and do not affect entries allocated prior to the effective date of the update.

We do not sell raffle tickets, or any other form of ticket to enter this contest
Each VIP Membership purchase includes a certain amount of entries to the vehicle giveaway at no cost.
Entries to the contest are strictly, and only provided as promotional prizes to VIP Members of Motor Culture Australia.
Entries cannot be purchased and will not be sold separately.
The contest can be won by any participant who purchases a VIP Membership from our website, or any official link.
The contest is funded in whole, by Motor Culture Australia.
The contest is solely promoted by Motor Culture Australia Pty Ltd, ABN 34643349357

Representation and warranties of the participant

The Participant represents and warrants that it shall not contact any affiliate, employee, sponsor, or partner of Motor Culture Australia in order to manipulate the Contest results.

DISCLAIMER

By becoming a VIP Member of Motor Culture Australia the Participant agrees to enter the Contest and Agrees that:

Any and all disputes, claims and causes of action arising out of or in connection with the Contest and the promotional prizes shall be resolved individually with any form of class action;

Any claims, judgments and awards shall be limited to actual out of pocket costs incurred in entering the Contest, but under no circumstances will Motor Culture Australia be responsible for any legal fees;

Participants hereby waive all rights to claim punitive, incidental or consequential damage and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses incurred in entering the contest.

In no event will Motor Culture Australia, their licensees, parents, affiliates, subsidiaries and related companies, their advertising or promotional agencies or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising from access to, or use of, this website, electronic or computer malfunctions, or entrant participation in this contest, even Motor Culture Australia was advised of the possibility of such damages.

Motor Culture Australia reserves the right to disqualify any Participant found to be tampering with or otherwise abusing any aspect of this Contest as solely determined by Motor Culture Australia.

In the event the Contest is compromised by non-authorised human intervention, tampering or other causes beyond the reasonable control of Motor Culture Australia, that corrupt or impair the administration, security, fairness or proper operation of the Contest, Motor Culture Australia reserves the right to suspend, modify or terminate the Contest.

Any attempt by a Participant to deliberately damage the website or undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, Motor Culture Australia reserves the right to seek damages from any such Participant to the fullest extent permitted by Law.

Motor Culture Australia assumes no responsibility for any problems or technical malfunction of computer systems, servers, software, internet service provider, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible or misdirected electronic communications, or any combination thereof.

The Contest is void where prohibited or restricted by law.

This Terms and Conditions is the property of Motor Culture Australia, you may not copy or distribute any part of this material without prior written approval from Motor Culture Australia. Any plagiarism or misuse of this material will carry legal consequence.

Photography, Videography & Media

Motor Culture Australia Pty Ltd ("Motor Culture Australia", "we", "our" or "us") may capture, create or otherwise obtain photographs, video, audio and other media in connection with our business activities, including but not limited to events, activations, promotional campaigns, competitions, memberships, prize handovers, livestreams, interviews, podcasts, social media content, commercial productions and other activities conducted, organised, hosted or supported by Motor Culture Australia.

Where you participate in, attend or otherwise engage with any Motor Culture Australia activity, you acknowledge that your image, voice, likeness, vehicle and other identifying features may be captured or recorded.

Subject to any applicable Event Terms & Conditions or other specific participation terms, you grant Motor Culture Australia Pty Ltd a perpetual, worldwide, irrevocable, royalty-free licence to use, reproduce, edit, publish, communicate, display, distribute and otherwise exploit such content in any media now known or developed in the future for promotional, marketing, advertising, editorial, commercial and archival purposes.

You acknowledge and agree that Motor Culture Australia may provide, licence or otherwise authorise the use of such content to its related entities, sponsors, commercial partners, event partners, exhibitors, suppliers, media organisations, affiliates and other authorised third parties for their own promotional, marketing, advertising, editorial and commercial purposes, whether or not such use directly relates to Motor Culture Australia, its products, services or events.

Except where otherwise agreed in writing, no payment, royalty or other compensation will be payable in connection with the creation or use of such content.

Where an activity is subject to separate Event Terms & Conditions or other participation terms, those terms will apply in addition to these Terms of Service.

Event Photography, Videography & Media Release

By registering for or attending any Motor Culture Australia event, you acknowledge and agree that photography, videography, audio recordings and other media may be captured throughout the event.

You consent to Motor Culture Australia Pty Ltd capturing and recording your image, voice, likeness, vehicle and any associated content in which you appear.

You grant Motor Culture Australia Pty Ltd a perpetual, worldwide, irrevocable, royalty-free licence to use, reproduce, edit, publish, communicate, display, distribute and otherwise use such content in any media now known or developed in the future for promotional, marketing, advertising, editorial, commercial and archival purposes.

You further acknowledge and agree that Motor Culture Australia may provide, licence or otherwise authorise the use of such content to its related entities, sponsors, commercial partners, event partners, exhibitors, suppliers, media organisations, affiliates and other authorised third parties for their own promotional, marketing, advertising, editorial and commercial purposes, whether or not such use directly promotes Motor Culture Australia, its products, services or events.

No payment, royalty or other compensation will be payable in connection with the creation or use of such content.

If you do not wish to be individually featured in promotional material, you should notify a Motor Culture Australia representative prior to or during the event. While reasonable efforts will be made to accommodate such requests, Motor Culture Australia cannot guarantee that you will not appear incidentally in crowd photography, videography or other media captured during the event.

Silverado Contest Terms and Conditions

Introduction

Motor Culture Australia Pty Ltd (hereinafter referred to as ‘Motor Culture Australia’ or ‘We’ or ‘Us’ or ‘Our’) is conducting a lucky draw (hereinafter referred to as the ‘Contest’) for Individuals th (hereinafter referred to as ‘Participants’ or ‘You’ or ‘Your’). The Contest will commence on 15of nd July 2026 and will conclude on 2of August 2026 at 11:59pm (‘Contest Period’).

Prizes

Our total prize pool is valued at $168,000 which is made up of and will be drawn in the following order: st

1 Prize –2024 Chevrolet Silverado HD, valued at $165,000 nd
2 Prize – $2,000 Cash, valued at $2,000 rd
3 Prize – $1,000 Cash, valued at $1,000

Eligibility

To be eligible to enter the contest you must purchase one of our official Events Memberships during the Contest Period. This will automatically enter you into the contest at no additional fee. You may purchase Events Memberships through our website https://www.motorcultureaustralia.com/ or by telephoning us directly.

By purchasing a Membership, you agree that you have read these Terms & Conditions and agree to be bound by them.

The contest is open to all Australian residents (Except South Australia) over the age of 18 who enter in accordance with these terms and conditions of entry, except for employees of Motor Culture Australia, their immediate family members (parents, spouses, domestic partners, siblings and children) or any other person residing in their household.

Existing VIP members (who hold an ongoing subscription with us) will all be entered into the Contest. There is no limit on the number of VIP members who may be entered into the Contest.

In addition, there is no limit to the number of participants who may enter during the Contest Period (Unless otherwise stated on the website. In the event of a limit, the limit does not include existing VIPs and MCA customers). Please note that each participant may hold more than one entry in the competition.

Vehicle Prize

The first prize winner may choose to take a cash prize of $100,000 instead of the vehicle. The Winner will have 24 hours to decide between the cash or the vehicle. Motor Culture Australia cannot provide the Winner with any financial or other advice as to which option they should choose.

In the event that the winner takes the vehicle we will cover the cost of registration for 6 months. Otherwise, the winner is solely responsible for paying any duties, taxes, registration fees, fuel, parts, servicing and operating costs associated with the vehicle.

To the extent permitted by law, the winner takes the vehicle on an “as is” basis, and Motor Culture Australia makes no representations or warranties that are not expressly stated in these terms. If a vehicle is advertised as not being road legal, the winner acknowledges that Motor Culture Australia will not be responsible for any costs associated with making the vehicle compliant with any laws. Where a vehicle includes custom modifications, the winner acknowledges that replacement parts may not be available in the future. The winner acknowledges that Motor Culture Australia will not be responsible for any costs associated with any costs of maintenance, operation or any other costs that are not expressly stated in these terms. Where the vehicle prize is a second-hand (used) motor vehicle, Motor Culture Australia will supply the vehicle, and will provide the winner with all documents, warranties and disclosures, in accordance with the trade promotion, gaming and consumer protection laws that apply in the State or Territory in which the Contest is drawn and/or in which the winner resides.

Motor Culture Australia is not liable for any damages incurred to any prizes after delivery. Winners will have 24 hours to bring any issues or imperfections forward to Motor Culture Australia for review regarding prizes before they are deemed to have been accepted in the condition it arrived.

We will hand over the prize to the winner Australia-wide, within 21 business days of announcing the winner subject to the prize winner being within a reasonable distance from a metropolitan area and subject to logistics and transportation availability.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

The Draw

The draw will be conducted with a Random Number Generator electronic draw system. The winner will be drawn and contacted immediately via phone and email. We will publish the names of winners th on our Facebook, Instagram and website 4of August 2026. Winning Participants will be invited to participate in a prize acceptance handover video or photograph for publication on our website. Participation is voluntary, and winners may opt out by notifying us in writing.

If the prize is unclaimed for longer than 90 days from the initial draw, we will make an rd th announcement on 3 of November 2026 and then conduct a redraw on 4of November 2026 at 1pm AEST, at Motor Culture Australia, 3B 50 Manton St, Morningside QLD 4170. The Redraw will be conducted via a Random Number Generator electronic draw system. The winner will be drawn and contacted immediately via phone and email. MCA Scratch & Win 5.0 Contest Terms and Conditions Introduction Motor Culture Australia Pty Ltd (hereinafter referred to as ‘Motor Culture Australia’ or ‘We’ or ‘Us’ or ‘Our’) is conducting a lucky draw (hereinafter referred to as the ‘Contest’ or ‘MCA Scratch & Win Contest’) for Individuals (hereinafter referred to as ‘Participants’ or ‘You’ or th th ‘Your’). The Contest will commence on the 8 of July 2026 and will conclude on the 16 of August 2026 at 11:59pm AEST.

All purchases of Events Memberships are final and cannot be refunded due to a change of mind or at the conclusion of the promotion unless otherwise defined by the Motor Culture Australia refund policy. The contest is open to all Australian residents (Except South Australia) over the age of 18 who enter in accordance with these terms and conditions of entry, except for employees of Motor Culture Australia, their immediate family members (parents, spouses, domestic partners, siblings and children) or any other person residing in their household. Existing VIP members (who hold an ongoing subscription with us) who enter into the contest will also be put into a VIP-Only Second Chance Draw to win.

Entrants must purchase a membership of Motor Culture Australia and be a registered member of the Motor Culture Australia, and agree to participate in the MCA Scratch & Win Game in the manner directed within the Motor Culture Australia website. Plays MCA Scratch & Win plays will only be available in digital form. A maximum of 340,000 plays will be available in this contest.

On an overall basis across all available Plays, not fewer than one (1) in four (4) Plays will correspond to a prize as configured in the secure prize database at launch. For the avoidance of doubt, we do not guarantee that Entrants who have 4 or more Plays will find a Play that yields a prize. A Play cannot be transferred by the Entrant who purchased eligible products or services, to any other person.

These numbers are pre-assigned to specific prizes in a secure, randomised database prior to the commencement of the Contest. Where a Major Instant Prize is deemed unclaimed, the Promoter will conduct a redraw using a third-party government-approved electronic draw system. The redrawn winner will be contacted immediately by phone and email, and their first name, last name initial, and postcode will be published on Motor Culture th Australia's website on the 19 of November 2026. If a Major Instant Prize remains unclaimed after the redraw, the Promoter may conduct further redraws or otherwise deal with the prize in accordance with applicable State and Territory laws and any regulatory directions. b. Unclaimed Minor Instant Prizes Minor Instant Prizes are won at the moment of play and are subject to verification by the Promoter. To claim a Minor Instant Prize, a winner must (i) respond to the Promoter's verification request within 14 days of being notified, (ii) provide such proof of identity, age, residency and eligibility as the Promoter reasonably requires, and (iii) provide delivery details (where applicable) within 30 days of notification. Where a Minor Instant Prize winner: (a) does not respond to verification requests within 14 days of being notified; (b) fails verification; (c) cannot be contacted using the contact details supplied at entry, despite the Promoter making at least two contact attempts via email and/or SMS; (d) declines the prize; or (e) otherwise fails to claim the Minor Instant Prize within 30 days of notification, the winner forfeits all rights to the Minor Instant Prize and no compensation or substitute prize is payable. The Promoter may dispose of any forfeited Minor Instant Prize in any appropriate manner, including (without limitation) allocating the prize to a subsequent promotion conducted by the Promoter, allocating the value to the VIP Only Second Chance Draw prize pool, awarding the prize or a substitute prize of equal or greater value to another Member through a further draw, donating the prize to a registered charity, retaining the prize, or in any other manner the Promoter deems appropriate. The Promoter is not obliged to redraw forfeited Minor Instant Prizes. c. Unawarded prizes The Promotion makes available up to the number and value of prizes advertised in the prize table. Prizes are available to be won during the Promotion Period subject to the receipt of valid winning entries in accordance with these Terms and Conditions. Any prize that is not triggered by a winning entry, that is rendered invalid through system or entry non- compliance, or that otherwise remains undistributed at the conclusion of the Promotion Period is an unawarded prize and will not be carried forward beyond the Promotion Period. For the avoidance of doubt, an unawarded prize is distinct from an unclaimed prize. An unclaimed prize is a prize that was won (whether by draw or instant-win) but was not validly claimed. An unawarded prize is a prize that was never won. d. Records and compliance The Promoter will maintain appropriate records of all awarded, unclaimed, forfeited and unawarded prizes in accordance with applicable state and territory regulations. Introduction

Motor Culture Australia Pty Ltd (hereinafter referred to as ‘Motor Culture Australia’ or ‘We’ or ‘Us’ or ‘Our’) is conducting a promotion (hereinafter referred to as the ‘Contest’ or ‘MCA Scratch & Win Contest’) for Individuals (hereinafter referred to as ‘Participants’ or ‘You’ or ‘Your’). The Contest will commence on the 10th of July 2026 and will conclude on the 18th of October 2026 at 11:59pm AEST. (‘Contest Period’).

Eligibility

To be eligible to enter the contest you must purchase one of our official VIP Members Club Memberships during the Contest Period. This will automatically enter you into the contest at no additional fee. You may purchase VIP Members Club Memberships through our website https://www.motorcultureaustralia.com/ or by telephoning us directly. By purchasing a VIP Membership, you agree that you have read these Terms & Conditions and agree to be bound by them. All purchases of VIP Memberships are final and cannot be refunded due to a change of mind or at the conclusion of the promotion unless otherwise defined by the Motor Culture Australia refund policy. The contest is open to all Australian residents (Except South Australia) over the age of 18 who enter in accordance with these terms and conditions of entry, except for employees of Motor Culture Australia, their immediate family members (parents, spouses, domestic partners, siblings and children) or any other person residing in their household. In addition, there is no limit to the number of participants who may enter during the Contest Period (Unless otherwise stated on the website. Every valid entry submitted during the Promotion Period has a fair and equal chance of winning any of the prizes available in the promotion.

Travel Prize The following two (2) individual holiday packages may be awarded as prizes in this promotion. Prize Handover

Prizes will be awarded to verified winners within 7 business days after the Promoter has successfully contacted the winner and completed the required verification process. To receive a cash prize, the winner must verify their identity and set up a valid payout account through the Promoter’s nominated payment processor. The Promoter is not responsible for delays caused by incomplete or incorrect verification information provided by the winner. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

MCA Scratch & Win Contest Drawing Method

Each eligible participant will receive one or more randomly generated numbers upon purchase of a qualifying membership package, the entry numbers are randomly generated by a third-party government-approved Random Number Generator system. These numbers are pre-assigned to specific prizes in a secure, randomised database prior to the commencement of the Contest. Winning numbers and their corresponding prizes are predetermined and publicly published on our website to ensure transparency. If a participant’s randomly assigned number matches one of the winning numbers, they instantly win the associated prize. All prizes are awarded on a first-come, first-served basis according to valid claims. Winners will be notified onscreen and by email (as applicable) with instructions to claim the prize. Unless otherwise stated, winners must complete all required steps (including identity verification) within 14 days of notification. If a Major Instant Prize is not validly claimed within the claim period, a redraw will be conducted in accordance with sub-clause a of the Unclaimed and Unawarded Prizes section. If a Minor Instant Prize is not validly claimed within the claim period, the prize will be forfeited and dealt with in accordance with sub-clause b of the Unclaimed and Unawarded Prizes section. The names of the winners will be published on our website on the 19th of October 2026. Winning Members will be invited to participate in a prize acceptance handover video or photograph for publication on our website. Participation in promotional materials is voluntary, and winners may opt out by notifying us in writing. Every eligible Member has a random, fair, and equal chance of winning. One Member may win multiple prizes in the competition. Each winner must sign a Prize Acceptance Form as reasonably required by Motor Culture Australia before receiving their prize.

Winner Verification

Entrants may only enter this promotion in their own name. Entrants who provide incorrect, misleading, or fraudulent information are ineligible to participate in the promotion. All entries associated with any entrant deemed by the Promoter (Motor Culture Australia Pty Ltd) to have provided incorrect, misleading, or fraudulent information may, at the Promoter’s discretion, be deemed invalid. The Promoter reserves the right to request that an entrant produce (within the time requested) appropriate photo identification or other documentation (to the Promoter’s satisfaction, in its sole discretion) to confirm the entrant’s: identity, age, and residential address; eligibility to enter and claim a prize (including confirmation of active VIP membership where applicable); and accuracy of any information submitted in connection with the promotion. If any documentation required by the Promoter is not received within the requested timeframe, or if an entrant’s details or entries cannot be verified to the Promoter’s satisfaction, the entrant may be deemed ineligible, and their entries may be declared invalid. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant for: (a) tampering with the entry, game mechanics, or winner verification process; (b) submitting an entry not in accordance with these Terms and Conditions; or (c) engaging in any unlawful, misleading, or improper conduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from any offender are reserved. A prize will only be awarded following successful validation and verification of the winner’s eligibility and compliance with these Terms and Conditions, as determined by the Promoter or its nominated agents, in their sole discretion. The Promoter reserves the right to request that a winner and, if applicable, their companion(s) produce appropriate photo identification or other documentation (to the Promoter’s satisfaction) in order to confirm identity and age before awarding a prize. It is a condition of accepting a prize that each winner (and any companion, if applicable) sign a Prize Acceptance Form, eligibility declaration, and/or legal release as required by the Promoter in its discretion.

Unclaimed and Unawarded Prizes

The Promotion contains two categories of prize, each of which is subject to different unclaimed- prize rules reflecting the structure of the relevant prize: Major Instant Prizes, being the prizes identified as “Major” in the prize table; and Minor Instant Prizes, being the prizes identified as “Minor” in the prize table. Unclaimed Major Instant Prizes A Major Instant Prize is deemed unclaimed if the winner does not validly claim the prize in accordance with these Terms and Conditions within 90 days of being notified, despite the Promoter having made reasonable attempts to contact the winner using the contact details supplied at entry. Where a Major Instant Prize is deemed unclaimed, the Promoter will conduct a redraw using a third-party government-approved electronic draw system. The redraw will take place at 5:30pm AEST on the 19th of January 2027, at Motor Culture Australia, 3B 50 Manton St, Morningside QLD 4170. The redrawn winner will be contacted immediately by phone and email, and their first name, last name initial, and postcode will be published on Motor Culture Australia’s website on the 20th of January 2027. If a Major Instant Prize remains unclaimed after the redraw, the Promoter may conduct further redraws or otherwise deal with the prize in accordance with applicable State and Territory laws and any regulatory directions. Unclaimed Minor Instant Prizes Minor Instant Prizes are won at the moment of play and are subject to verification by the Promoter. To claim a Minor Instant Prize, a winner must (i) respond to the Promoter’s verification request within 14 days of being notified, (ii) provide such proof of identity, age, residency and eligibility as the Promoter reasonably requires, and (iii) provide delivery details (where applicable) within 30 days of notification. Where a Minor Instant Prize winner: (a) does not respond to verification requests within 14 days of being notified; (b) fails verification; (c) cannot be contacted using the contact details supplied at entry, despite the Promoter making at least two contact attempts via email and/or SMS; (d) declines the prize; or (e) otherwise fails to claim the Minor Instant Prize within 30 days of notification, the winner forfeits all rights to the Minor Instant Prize and no compensation or substitute prize is payable. The Promoter may dispose of any forfeited Minor Instant Prize in any appropriate manner, including (without limitation) allocating the prize to a subsequent promotion conducted by the Promoter, awarding the prize or a substitute prize of equal or greater value to another Member through a further draw, donating the prize to a registered charity, retaining the prize, or in any other manner the Promoter deems appropriate. The Promoter is not obliged to redraw forfeited Minor Instant Prizes. Unawarded prizes The Promotion makes available up to the number and value of prizes advertised in the prize table. Prizes are available to be won during the Promotion Period subject to the receipt of valid winning entries in accordance with these Terms and Conditions. Any prize that is not triggered by a winning entry, that is rendered invalid through system or entry non-compliance, or that otherwise remains undistributed at the conclusion of the Promotion Period is an unawarded prize and will not be carried forward beyond the Promotion Period. For the avoidance of doubt, an unawarded prize is distinct from an unclaimed prize. An unclaimed prize is a prize that was won but was not validly claimed. An unawarded prize is a prize that was never won. Records and compliance The Promoter will maintain appropriate records of all awarded, unclaimed, forfeited and unawarded prizes in accordance with applicable state and territory regulations. Nothing in this clause affects the Promoter’s separate obligations in relation to unclaimed prizes, which shall be dealt with in accordance with the requirements and timelines prescribed by the applicable laws of each Australian State and Territory.

Representations and Warranties

Motor Culture Australia warrants the following;

a. The prizes involved in the contest are owned or funded by Motor Culture Australia;
b. The purpose of this contest is to promote the Motor Culture Australia brand and bring awareness to the Motor Culture Australia brand;
c. We will not sell raffle tickets, or any other form of ticket to enter this contest. Entry to the contest is strictly provided as a promotion when purchasing membership with us, and cannot be purchased separately; and
d. The contest is wholly funded by Motor Culture Australia Pty Ltd.
e. The contest is solely promoted by Motor Culture Australia Pty Ltd, ABN 34 643 349 357, of 3B 50 Manton St, Morningside QLD 4170. The Participant represents and warrants that it shall not contact any affiliate, employee, sponsor, or partner of Motor Culture Australia in order to manipulate the Contest results.

Disclaimers

a. Except for any liability that cannot be excluded by law, including under the Australian Consumer Law, Participants hereby waive all rights to claim punitive, incidental or consequential damage and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses incurred in entering the contest.
b. In no event will Motor Culture Australia, our licensees, parents, affiliates, subsidiaries and related companies, our advertising or promotional agencies or respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising from participation in this contest.
c. Motor Culture Australia reserves the right to disqualify any Participant found to be tampering with or otherwise abusing any aspect of this Contest as solely determined by Motor Culture Australia.
d. In the event the Contest is compromised by non-authorised human intervention, tampering or other causes beyond the reasonable control of Motor Culture Australia, that corrupt or impair the administration, security, fairness or proper operation of the Contest, Motor Culture Australia reserves the right to suspend, modify or terminate the Contest.
e. Any attempt by a Participant to deliberately damage the website or undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, Motor Culture Australia reserves the right to seek damages from any such Participant to the fullest extent permitted by law.
f. Motor Culture Australia assumes no responsibility for any problems or technical malfunction of computer systems, servers, software, internet service provider, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible or misdirected electronic communications, or any combination thereof.
g. The Contest is void where prohibited or restricted by law.
